TAX SALE – FREQUENTLY ASKED QUESTIONS

1.    Where do I submit my Bid?
Bids can now be submitted directly on the  Halifax Regional Municipality website -  www.halifax.ca/form/bid-submission-form Please ensure you complete all information on the form and that the information for your bid is accurate. Bid forms can also be submitted in a sealed plain envelope marked “Halifax Regional Municipality Tax Sale Property Tender” to the Alderney Customer Service Centre located at 40 Alderney Drive, Dartmouth, Nova Scotia between 8:30AM and 4:30PM. The bid form can be found in the tender document below.  

2.    Can I submit my bid now?
Yes, your bid can be submitted as soon as the tender is posted but must be submitted no later than 10:00 am on the closing day for the Tender.

3.    Why does it say Bids Closing at 10:00 am and Bids Opening at 10:01 am?
All Bidding promptly closes at 10:00 am.  Opening of the bids commences at 10:01 AM.

4.    Can I bid on more than one property?
You are permitted to submit one bid per property, but if you are the successful bidder of multiple properties, you must be prepared to pay the bid price for all properties within three (3) business days of winning the bid(s).  The Halifax Regional Municipality may formally disqualify or suspend a person from bidding on any tax sale tender opportunities for a period not exceeding one (1) year, on grounds that the party tendering has failed to pay the full amount of the tender price within the three (3) business days after awarding of the Tender.

5.    Is there a deposit required when submitting my bid? 
No deposit required. The successful Bidder(s) will be given three (3) business days after the Tender has been awarded to pay the amount in full, in cash, certified cheque, money order, bank draft, irrevocable letter of credit or a lawyer’s trust cheque.  If a purchaser does not have proof of their HST registration number than HST will also be due and payable on all commercial properties and vacant land.

6.    How can I research the properties I am interested in?
Research is your responsibility as a bidder and HRM does not assist with this.  You can choose to conduct your own research or seek legal counsel at your own cost.  You can find more details from Property Valuation Services Corporation by using the following link and searching by AAN number.

7.    Can I see the highest Bid?
No, bids are sealed and not opened until the Tender closes.

8. Will I be contacted after the bidding closes?
Only the successful bidder will be contacted following the closing of bids by telephone and by email.  Please do not call our office to see if you were the successful bidder.  We ask that you allow our office sufficient time to review and record bid information.  It takes time to verify and record all bids.  Once we have completed this recording all bids, we will be contacting the successful bidder.  Timeline for this depends on the number of bids received.

In accordance with the Halifax Regional Municipality Charter, public notice is hereby given that the lands & premises listed in Schedule “A” attached hereto shall be sold by Tender.  
Tender Document and Specifications can be viewed here: HRM-TAXSALE16 – TENDER DOCUMENT Bidders must complete and submit a separate bid form for each property they wish to bid on.

SEALED TENDERS are to be submitted:
•    in digital format via submission to Halifax Regional Municipality’s website www.halifax.ca/form/bidsubmission-form .  
•    on the Halifax Regional Municipality’s bid form in a plain envelope marked “Halifax Regional Municipality Tax Sale Property Tender”, to the Alderney Customer Service Centre located at 40 Alderney Drive, Dartmouth, Nova Scotia between 8:30AM and 4:30PM; or
These bids will only be accepted until 10:00am on Tuesday, November 26, 2024.
HRM will not accept bids submitted by any other method, including by facsimile or email.
Tender Opening: This Tender will be opened on Tuesday, November 26, 2024 at 10:01 am.
The Halifax Regional Municipality reserves the right to reject any or all tenders or to accept any tender or part thereof considered to be in its best interest.
THE HALIFAX REGIONAL MUNICIPALITY MAKES NO REPRESENTATIONS OR WARRANTIES TO ANY PURCHASER REGARDING THE FITNESS, GEOGRAPHICAL OR ENVIRONMENTAL SUITABILITY OF THE LAND(S) OFFERED FOR SALE FOR ANY PARTICULAR USE AND DOES NOT CERTIFY THE LEGAL TITLE, LEGAL DESCRIPTION OR BOUNDARIES AND THE LANDS OFFERED FOR SALE ARE BEING SOLD ON AN “AS IS” BASIS ONLY, SUBJECT TO ANY ESTATES OR INTERESTS OF THE CROWN IN RIGHT OF CANADA OR THE PROVINCE OF NOVA SCOTIA.
TAKE NOTICE that tax sales do not in all circumstances clear up defects in title. A tax deed conveys only the interest of the assessed owner, whatever that interest may be.
If you are intending to clear up defects in the title of your property by way of a tax sale, you are advised to obtain a legal opinion as to whether or not this can be done. The purchaser will be responsible for all property taxes beginning the day of the sale. Please see the tender document for the full list of terms and conditions applicable to the tender.

Any zoning concerns should be directed to the appropriate department.
The successful Bidder(s) will be notified and be given three (3) business days after awarding of the Tender to pay the amount in full or the property will be awarded to the next successful bidder or re-tendered.
TERMS: PAYMENT OF CASH, CERTIFIED CHEQUE, MONEY ORDER, BANK DRAFT, IRREVOCABLE LETTER OF CREDIT OR LAWYERS TRUST CHEQUE WILL BE ACCEPTED AND NOT IN ANY OTHER FORM. IF A PURCHASER DOES NOT HAVE PROOF OF A HST REGISTRATION NUMBER THEN HST IS DUE AND PAYABLE AT THE TIME OF SALE.
NO COUNCIL MEMBER OR EMPLOYEE OF THE HALIFAX REGIONAL MUNICIPALITY OR THEIR SPOUSE, OR A COMPANY IN WHICH A COUNCIL MEMBER, EMPLOYEE, OR THEIR SPOUSE OWNS OR BENEFICIALLY OWNS
THE MAJORITY OF THE SHARES SHALL PURCHASE PROPERTY AT A TAX SALE CONDUCTED BY THE HALIFAX REGIONAL MUNICIPALITY. (Pursuant to Section 159 of the HRM Charter)
A person with an interest in land sold for taxes may apply to the Supreme Court of Nova Scotia for an order directing the payment of all, or part, of the surplus balance to that person. (Section 162 of the HRM Charter). Tax sale surplus funds can only be withdrawn after any applicable  redemption period has expired.
