Application by the property owner, Star of the Sea B7B requesting to deregister Lot 1SM1-1 (PID 41518333), a vacant parcel of land located at 12 York Redoubt Crescent, Fergusons Cove, which was subdivided from the municipally registered heritage property known as Stella Maris Church (the church will remain registered).
Proposal
Background
The property at 4 York Redoubt Crescent, Fergusons Cove has been a Municipally Registered Heritage Property since 1994. The property contains the former Stella Maris Church.The property owner has recently subdivided the property as shown on Attachment A to create two lots as follows:
12 York Redoubt Cresent New Lot: 1SM1-1 (PID 41518333) Vacant
4 York Redoubt Cresent Remainder Lot: 1SM1 (PID 40079733) Contains church
The subdivision process cannot change a heritage designation boundary of a Municipally Registered Heritage Property. Consequently, a heritage designation is applied to both 4 and 12 York Redoubt Cresent. The intention of the property owner is to develop and/or sell 12 York Redoubt Cresent. As 12 York Redoubt Cresent retains its heritage designation, any development proposed on the property is subject to heritage standards and requirements. Therefore, the property owner has requested that the heritage designation applied to 12 York Redoubt Cresent be removed pursuant to Section 16(1)(b) of the Heritage Property Act.
Process
Council shall hold a public hearing on the deregistration, the hearing must be held not less than thirty days after a notice of the hearing is served on the registered owner of the municipal heritage property and published in a newspaper circulating in the area (a notice has been published in the December 21, 2024 edition of the Chronicle Herald). If the property is deregistered, the Heritage Property Act requires that Council shall cause notice of the deregistration to be sent to the registered owner of the property and a copy thereof to be deposited in the registry of deeds for the registration district in which the property is situated.
Status
Halifax Regional Council intends to consider and, if deemed advisable, approve the following applications:
HRTG-2023-00861 – Application by Star of the Sea B&B to deregister Lot 1SM1-1, a vacant parcel of land located at 12 York Redoubt Crescent, Fergusons Cove, which was subdivided from the municipally registered heritage property known as Stella Maris Church (the church will remain registered).
A public hearing for deregistration will be held by Halifax Regional Council on Tuesday, January 28, 2025, at 6:00 p.m. at Halifax City Hall (Council Chamber), 1841 Argyle Street, Halifax, NS. All oral and written submissions will be considered at that time. Written submissions may be forwarded to the Municipal Clerk by mail, P.O. Box 1749, Halifax, Nova Scotia, B3J 3A5; by fax, 902-490-4208; or by e-mail, clerks@halifax.ca. Written submissions should be received by the Municipal Clerk’s Office as early as possible and not later than 3:00 p.m. on January 28, 2025.
