That Halifax Regional Council adopt the proposed amendments to Administrative Order 29 Respecting Civic Addressing Policies as set out in Attachment A of the staff report dated December 8, 2022 to approve the renaming of Cornwallis Street, Halifax to Nora Bernard Street, Halifax, as identified in Map 1 of the staff report dated December 8, 2022.

15.1.2 Facility Operating Agreement – The Bay Community Centre* [PDF]
Motion:
That Halifax Regional Council authorize the Chief Administrative Officer (CAO) to: 

1. Execute a Facility Operating Agreement (FOA) with the Head of St Margaret’s Bay/Boutilier’s Point Recreation Association for the Bay Community Centre facility at 11 Station Road, Head of St. Margaret’s Bay substantially in the same form as set out in Attachment 1 of the staff report dated November 28, 2022; 

2. Direct staff to negotiate a Less than Market Value Lease Agreement with The Unicorn Theatre Society for the existing occupied space at 11 Station Road, and return a staff report to Grants Committee for the approval of the key terms and conditions; and 

3. Direct staff to negotiate a Less than Market Value Lease Agreement with the Safety Minded ATV Association for the Bay Community Centre facility at 15 Station Road, and return a staff report to Grants Committee for the approval of the key terms and conditions.

That Halifax Regional Council:

1.  Give First Reading to By-law C-901, repealing By-law C-900 - the Charges for Stormwater from Municipal Streets By-law, as set out in Attachment 1 of the staff report dated November 30, 2022; and

2. Adopt the boundaries for a new Stormwater Right-of-Way area rate, effective on April 1, 2023, as shown in Attachment 2 of the staff report dated November 30, 2022.

1. Suspend the rules of procedures requiring the Executive Standing Committee to review the nominations outlined in the staff report dated December 2, 2022 and make a recommendation to Regional Council;

2. Appoint Councillor Lovelace, as the representative from Transportation Standing Committee, to serve on the Canadian Urban Transit Association, for a term to the end of the Council term; 

3. Appoint Councillor Deagle Gammon, as the representative from Environment and Sustainability Standing Committee, to serve on the Halifax Regional Water Commission, for a term to the end of the Council term; and

That Halifax Regional Council direct the Chief Administrative Officer to:

1. Initiate a process to consider amendments to the Halifax Municipal Planning Strategy and the Halifax Mainland Land Use By-law to allow mixed-use medium density development within the study area outlined within the staff report dated December 5, 2022; and

2. Follow the public participation program for municipal planning strategy amendments as approved by Regional Council on February 27, 1997.

That Halifax Regional Council direct the Chief Administrative Officer to:

1. Initiate a process to consider amendments to the Regional Centre Secondary Municipal Planning Strategy and Land Use By-law to enable comprehensive development of the M District Future Growth Node located between Micmac Boulevard and Horizon Court;

2. Consider, as part of the M District Future Growth Node planning process, the October 26, 2021 direction of Regional Council to prepare amendments to the Regional Centre Land Use By-law to increase the maximum tower dimensions established for the Mic Mac Mall Lands (ML) Special Area; and

3. Follow the public participation program as set out in Attachment A of the staff report dated December 5, 2022.

15.1.8 COVID-19 Transit Funding [PDF]

That Halifax Regional Council:

1. Agree to the terms and conditions per the letter from the Provincial Minister of Public Works in Attachment 1 of the staff report dated December 6, 2022, by authorizing the Mayor and Municipal Clerk to sign the attached letter to receive $8,655,876 in funding from the Government of Canada and Province of Nova Scotia related to COVID-19 impacts on transit services.

2. Direct the Chief Administrative Officer to allocate the funding to Halifax Transit as a revenue recovery to cost center R631.

That Halifax Regional Council give First Reading to consider the proposed amendments to the Municipal Planning Strategy and Land Use By-law for Beaver Bank, Hammonds Plains, and Upper Sackville, as set out in Attachments A and B of the staff report dated December 7, 2022, respectively, to enable smaller residential lots for a proposed subdivision called Carriagewood Estates off Daisy Drive in Beaver Bank and schedule a public hearing.

1. Initiate a process to consider amendments to the Municipal Planning Strategy and Land Use By-law for Planning District 4 to enable an industrial development on a 120-acre parcel of land in Goodwood through the provisions of a development agreement; and

2. Follow the public participation program for municipal planning strategy amendments as approved by Regional Council on February 27, 1997.

That Halifax Regional Council:

1. Give First Reading to consider the proposed amendments to the Regional Municipal Planning Strategy (Regional Plan), Secondary Municipal Planning Strategies (SMPSs), and all Land Use By-laws (LUBs) as set out in Attachments A, B and C of the staff report dated December 7, 2022 to establish consistent region wide policies and regulations for short-term rentals and schedule a public hearing; and

2. Direct the Chief Administrative Officer (CAO) to prepare a staff report that explores approaches to tourist accommodations in rural parts of the Municipality that are outside of the urban service area boundary.

15.1.12 Herring Cove Servicing - Phase 2B and 4 Update [PDF]
Motion:
That Halifax Regional Council direct the Chief Administrative Officer to:

1. Not proceed with construction of Phase 2B and Phase 4 of the Herring Cove Project, at this time;

2. Notify the Province that the Municipality will not be proceeding with the Project but request that the funding remain allocated to the project; and

3. Apply under future funding programs, should they become available, to offset the increased costs to complete both Phase 2B and Phase 4 at the same time.

15.2 AUDIT AND FINANCE STANDING COMMITTEE
15.2.1 Proposed Amendments to Administrative Order 2014-020-GOV, Respecting Marketing Levy Special Event Reserve Grants and Administrative Order 2014-021-GOV, Respecting Regional Special Events Grants – Inclusion of an Interrupter Clause [PDF]

That Halifax Regional Council:

1. Adopt the amendments to Administrative Order 2014-020-GOV – Respecting Marketing Levy Special Event Reserve Grants as set out in Attachment B of the staff report dated November 4, 2022; and

2. Adopt the amendments to Administrative Order 2014-021-GOV, Respecting Regional Special Events Grants as set out in Attachment D of the staff report dated November 4, 2022.

15.3 BUDGET COMMITTEE
15.3.1 2023/2024 Budget Direction [PDF]
Motion:
That Halifax Regional Council:

1. Rescind the direction from the 2022-23 fiscal budget to include $7 million in the 2023/24 budget to fund a sidewalk program from capital from operating; and 

2. Reallocate $20 million included in the Strategic Initiative Operating Reserve (Q667) in 2019 as a potential capital contribution for the construction of a Community Stadium, to the following reserves: 
    • Transfer $5 million to the Options Reserve (Q421) for the Solid Waste Facility capital project (CW190003); 
    • Transfer $15 million to the Capital Fund Reserve (Q521) to fund over-commitments within the capital fund reserve; and 

3. Approve revised debt policy of $1,500 per dwellings and amend capital-from-operating to be $64.922 million, by reducing $8 million from street recapitalization, for the 2023/24 budget.

That Halifax Regional Council adopt the Bedford West Park Facilities Plan as set out in Attachment B of the November 14, 2022 staff report as a guiding document for future park improvements in the Community of Bedford West.

Motion:
That Halifax Regional Council direct the Chief Administrative Officer to:

1. Engage with other tenants, stakeholders and the public to obtain feedback on the project as presented at the November 17, 2022 Community Planning and Economic Development Standing Committee presentation from the Board of the Halifax Public Gardens Foundation; and

2. Prepare a staff report assessing the proposal for incorporation into further development of the Wanderer’s Block within the context of the 2022 Halifax Common Master Plan as approved in principle, and identifying possible funding sources, and exploring governance models for the Public Gardens as a whole.
